Los Cabos is famous for its laid-back, festive party atmosphere. Whether you are drinking margaritas on Medano Beach or dancing at a nightclub downtown, the vibe is meant to be totally carefree. Because of this relaxed reputation, many travelers are shocked to find out that local laws in Mexico can actually be much stricter than back home.
When you step off the resort property, you are subject to rules that are heavily enforced. Breaking them comes with consequences that will cost you massive amounts of time and money. If you want to enjoy your vacation without seeing the inside of a local police station, here are the five main things that constantly get tourists into trouble.
1. Walking Around Drunk In Public

There is a massive difference between having a good time at your resort swim-up bar and stumbling down the street. Public intoxication is illegal in Mexico, and local police strictly enforce open container laws. You cannot walk out of a bar with your beer and stroll down the sidewalk.
If you are visibly, heavily drunk in public, you are drawing a target on your back. Do not try to walk back to your hotel if you can barely stand. It practically guarantees a trip to the local “drunk tank” and a hefty fine to get released. If you have had too much to drink, stay at your resort. If you are in town, have a friend call an Uber or a trusted taxi to get you directly to your room.
2. Vaping And Smoking In Public Areas

You might think hitting a vape or lighting a cigarette on the beach is no big deal, but Mexico currently has some of the absolute strictest smoking and vaping laws in the entire world. In 2023, the country banned smoking in all public spaces, including beaches, parks, and town squares.
Things got even more intense in early 2026. A massive federal reform made it entirely illegal to bring vaping devices or e-cigarettes into the country. If customs agents find a vape in your luggage at the airport, it will be confiscated, and you could face massive fines. Using these devices in public areas around Los Cabos will immediately draw the attention of law enforcement, leading to expensive tickets and the loss of your device.
3. Public Urination

This might seem like a total no-brainer, but it continuously fills social media threads and travel forums. Do not go to the bathroom in public. It does not matter if you are on a sunset boat ride that went a little too long and you try to find a quiet spot on the beach, or if you are walking home late at night after the club closes.
There are endless reports of police having absolute zero tolerance for this behavior. You will not get a warning or a slap on the wrist. You will be arrested and heavily fined. Always use the restroom at the restaurant or club before you start heading back to your hotel.
4. Possession Of Any Type Of Drugs

While marijuana laws have rapidly relaxed across the United States and Canada, they absolutely have not in Mexico. Buying, possessing, or using any type of recreational drug—including medical marijuana—is a severe federal crime.
Do not assume that because you are in a tourist town, the rules are bent. Buying anything off the street is incredibly high-risk behavior that can land you in serious, long-term trouble with the legal system. There is no leniency for tourists who claim they did not know the law. Leave it all at home and enjoy the incredible food and drinks instead.
5. Disturbing The Tourist Experience

Tourism is the crown jewel of the Los Cabos economy. The local community, the police, and resort security teams work incredibly hard to protect that engine. Because of this, there is zero tolerance for anyone actively ruining the experience for other guests.
Arguing aggressively with staff, getting into physical fights, or showing obnoxious, rude behavior will be met with a rapid response. Resorts will expel you from the property without a refund and without any warning. Local police are also quick to intervene if a tourist is making a scene or making others feel unsafe. Keep your cool, treat the locals with respect, and remember that you are a guest in their country.
